Welcome to the LIV website (the "Site"). Use of the Site, including making purchases through it, is subject to these Terms. Using the Site constitutes the user's agreement to all of these Terms.

The Site is operated by the sole proprietorship LIV.

Use of the Site

The Site may be used for private, personal and lawful purposes only, in accordance with these Terms and with all applicable law.

Without derogating from any other provision of these Terms, the user undertakes not to make any unauthorized use of the Site or its content, including any use that is unlawful or commercial, or that is liable to harm the proper operation of the Site, its security, the Company's reputation, the Company's intellectual property rights, or the rights of third parties.

Without derogating from the above, it is prohibited, among other things, to carry out through or in connection with the Site any act of copying, reproduction, distribution, publication, modification, reverse engineering, data mining, use of automated means to scrape the Site, or any other act liable to burden the Site's systems or disrupt their operation, unless the Company's express prior written approval has been obtained.

The Company reserves the right to update, change, add to or remove, at any time and at its discretion, the content of the Site, the range of products, product prices, promotions, the terms of use, the structure of the Site and any service offered through it — all without any need for prior notice. Such updates take effect upon their publication on the Site, unless stated otherwise.

Placing orders

Placing an order through the Site constitutes an offer by the customer to purchase the products it contains, subject to these Terms.

Receipt of an order by the Site's systems does not constitute confirmation of its acceptance and does not create a binding engagement between the parties. An order is deemed complete only after approval is received from the credit card company or the relevant payment method, the transaction details are verified, and an order confirmation is sent to the customer by the Company.

The Company reserves the right, at its reasonable discretion, not to approve or to cancel an order, in whole or in part, including in the following cases:

A technical, system or communications fault occurred that affected the order process.
A clerical error occurred, or an error in price, product description, product images or any other material detail published on the Site.
The ordered product is out of stock or unavailable for supply.
There is a concern, at the Company's reasonable discretion, that the order was placed through unlawful use, contrary to law, using incorrect details, or as part of an attempted fraud.
Circumstances beyond the Company's control arose, including force majeure events, security events, strikes, lockouts or any other event preventing the proper processing of the order or supply of the products.

Where an order is cancelled in such circumstances, the Company will notify the customer as soon as possible, and to the extent payment was collected for the order, the amount actually paid will be refunded to the customer via the payment method used for the transaction, in accordance with law. Such cancellation does not entitle the customer to any compensation or additional remedy, except as otherwise provided by law.

Prices

All prices displayed on the Site are denominated in New Israeli Shekels (₪), unless the user has chosen to display prices in another currency, where that option is available on the Site. It is clarified that the transaction will be charged in the currency and on the terms displayed at the time the order is placed.

Prices displayed on the Site include Value Added Tax (VAT), to the extent it applies to the transaction under law.

The Company may update, from time to time and at its discretion, product prices, promotions, discounts and terms of sale — all without prior notice. It is clarified that such an update will not apply to orders that were completed and duly confirmed before the update took effect.

The binding price for the transaction is the price published on the Site at the time the order process was completed and the transaction was confirmed by the Company, subject to these Terms.

It is clarified that in the event of a clerical error, technical error or other fault that led to the display of an incorrect or unreasonable price, the Company may cancel the transaction, subject to law, and will notify the customer as soon as possible. To the extent payment was collected for the transaction, the full amount paid will be refunded via the payment method used for the transaction.

Product availability

All products offered for sale on the Site are subject to the stock available at the time the order is placed. Although the Company works to keep product stock updated on an ongoing basis, there may be cases in which an ordered product is out of stock, unavailable for supply or cannot be supplied — even after the order has been placed.

In such a case, the Company may, at its reasonable discretion, cancel the order in whole or in part, or offer the customer an alternative product with similar characteristics, to the extent a suitable product is in stock.

It is clarified that the customer is not obliged to accept the alternative product, and may choose between accepting it and cancelling the order and receiving a full refund of the consideration paid for the product that could not be supplied, via the payment method used for the transaction and in accordance with law.

The Company shall not be liable for any indirect, consequential or special damage caused by the unavailability of a product or the cancellation of an order in such circumstances, other than liability that cannot be limited under any law.

Shipping

Products will be supplied in accordance with the Shipping Policy published on the Site, as updated from time to time, which forms an integral part of these Terms.

It is clarified that alongside the Shipping Policy, the delivery times published on the Site are estimated delivery times only, and the Company will make every effort to meet them. However, delays may occur due to circumstances beyond the Company's control, including delays on the part of the courier company, logistical loads, extreme weather conditions, force majeure events, strikes, lockouts, security events or any other circumstance beyond the Company's control.

Such delays shall not be deemed a breach of an undertaking by the Company and shall not entitle the customer to any compensation, except where otherwise provided by law.

Exchanges, cancellations and returns

Cancellation of transactions, exchange of products and return of products will be carried out in accordance with the Israeli Consumer Protection Law, 5741–1981, the Consumer Protection Regulations (Cancellation of a Transaction), 5771–2010, and any other applicable law.

The procedure, conditions, deadlines and costs involved in cancelling a transaction, exchanging a product or returning it are detailed in the Exchanges, Cancellations and Returns Policy published on the Site, which forms an integral part of these Terms. The Company may update the policy from time to time, provided that the update does not prejudice rights lawfully acquired before it took effect.

Liability

The Company makes reasonable efforts to ensure that the information, descriptions, images, specifications and prices published on the Site are as accurate, complete and up to date as possible. However, good-faith errors, inaccuracies or omissions may occur, and the Company reserves the right to correct them at any time.

It is clarified that there may be slight differences between the appearance of products as displayed on the Site and the actual products, including in shade, color, texture, dimensions or other details, due among other things to screen settings, lighting conditions, photography angles or production processes. Such differences, to the extent they do not constitute a material non-conformity with the product ordered, shall not be deemed a defect in the product.

Subject to any law, the Company shall not be liable for any indirect, consequential or special damage or loss of profits caused as a result of the use of the Site, reliance on the information appearing on it, or the purchase of products through it. Nothing in the above derogates from the Company's liability where it cannot be limited by law.

Intellectual property

All intellectual property rights in the Site, including copyright, trademarks, trade names, the brand name, the logo, the designs, images, videos, illustrations, texts, graphics, design files, the structure of the Site, the user interface, the code, the software and any other content appearing on the Site (the "Content"), are the exclusive property of the Company or of third parties who have lawfully licensed the Company to use them.

The Content may not be copied, reproduced, distributed, published, publicly displayed, translated, adapted, modified, reverse engineered, used to create derivative works, used commercially or transferred to another, in any medium and in any manner, in whole or in part, without the Company's express prior written consent.

Any unauthorized use of the Site's Content or of the Company's intellectual property rights may constitute an infringement of intellectual property law, entitle the Company to all remedies available to it by law, and render the infringer liable for damages and any other remedy provided by law.

Privacy protection

The Company respects the privacy of the Site's users and its customers and regards the protection of personal information as a core value of its activity. The Company acts in accordance with the law applicable in the State of Israel, including the Protection of Privacy Law, 5741–1981, the regulations enacted thereunder and the directives of the Privacy Protection Authority, as updated from time to time.

Use of the Site may involve the provision of personal information by the user, as well as the collection of technical information and information regarding the manner of use of the Site. Such information will be collected, stored and processed solely for legitimate purposes, including operating the Site, managing and fulfilling orders, supplying products, providing service and support, contacting the user, improving the user experience, information security, fraud prevention, compliance with legal requirements and any additional purpose detailed in the Site's Privacy Policy.

The Company will take reasonable and accepted information security measures, according to the nature of the information collected and the requirements of law, in order to protect the information in its possession against unauthorized access, prohibited use, loss, alteration or unlawful disclosure. However, the user is aware that no information security system provides absolute immunity, and accordingly the Company does not undertake that the Site or its systems will be absolutely immune to intrusion, disruption or unauthorized access.

The provisions of the Site's Privacy Policy, as published and updated from time to time, form an integral part of these Terms, and use of the Site constitutes agreement to the Privacy Policy, subject to law.

Direct marketing and the mailing list

Subject to the user's consent, to the extent required by law, the Company may add the user to its mailing list and send the user — by email, SMS, WhatsApp or any other means of communication the user provided — updates, benefits, promotions, product launches, marketing content and advertising material.

The user may, at any time and at no cost, remove themselves from the mailing list by clicking the unsubscribe link included in the mailing messages, by contacting the Company or by any other means available to them, all in accordance with law.

The Company will not send advertising material contrary to the Communications Law (Telecommunications and Broadcasting), 5742–1982, and will act in accordance with all law applicable to direct marketing and the sending of marketing messages.

Governing law and jurisdiction

These Terms are governed solely by the laws of the State of Israel.

Exclusive jurisdiction over any dispute concerning use of the Site or purchases made through it is granted to the competent courts of the Tel Aviv District, unless the law requires otherwise.
